The Complaint asserts that during the Class Period, the Defendants made materially false and/or misleading statements and failed to disclose critical adverse information regarding the Company’s business, operations, and prospects. Specifically, the Defendants did not inform investors that: (1) the Company had been experiencing deficiencies in its vehicle model quality assurance processes since 2022; (2) consequently, the Company was incurring higher warranty costs; (3) the Company’s warranty reserves did not accurately account for the quality issues in vehicles sold since 2022; (4) as a result, the Company’s profitability was likely to be adversely affected; and (5) therefore, the Defendants’ positive statements about the Company’s business, operations, and prospects were materially misleading and/or lacked a reasonable basis.
